Terms of Use

These Terms of Use ("Terms") govern the conditions of use of our Shop (including this website, hereinafter not distinguished separately). These Terms apply to all customers using our Shop.

Agreement to Terms By using our Shop, customers are deemed to have given valid and irrevocable consent to these Terms. Customers who do not agree to these Terms may not use our Shop.

Registration Those wishing to use our Shop must agree to these Terms and apply for registration using the methods established by our Shop. Registration is completed upon approval by our Shop.

Registration Denial Our Shop may choose not to approve a registration application for any of the following reasons, without any obligation to disclose the reason:

• If false information has been submitted
• If the applicant has previously violated these Terms
• Other cases where our Shop deems the registration as inappropriate

Use by Minors If you are a minor, please use our Shop only with the consent of your legal guardian. Customers who begin using our Shop without the consent of their legal guardian will be deemed to have ratified their use upon reaching the age of majority.

Login Information Management Customers are responsible for the appropriate management of their login information to our Shop. Under no circumstances may customers transfer or lend their login information to a third party or share it with a third party. Our Shop is not liable for any damage resulting from the use of login information by a third party, except in cases of intentional misconduct or gross negligence on the part of our Shop.

Orders When a product is ordered, the customer's order constitutes an application for a purchase contract with our Shop. Acceptance of the customer's application by our Shop is established when the Shop sends an email or other communication notifying that the product has been shipped.

Cancellation of Orders Cancellations of orders due to customer convenience are not accepted.

Termination Due to Violation of Terms Our Shop may terminate the sales contract with the customer without prior notice if the customer falls under any of the following circumstances. In this case, our Shop is not liable for any damages to the customer:

• If the customer has violated or is likely to violate these Terms
• If the customer or their affiliates have violated these Terms in the past
• Other cases where our Shop deems that the trust relationship with the customer has been impaired

Refusal of Receipt, etc. If the customer refuses to receive the product, the delivery destination is unknown, or delivery to the specified delivery destination is not possible due to customer circumstances, the round-trip shipping costs, cash on delivery fees, return administrative fees, product storage fees, re-delivery fees, costs for sending registered mail or other communications to the customer, packaging material costs, and labor costs for shipping and returning will be the damage to our Shop. Our Shop may charge these costs to the customer. If the period below has passed since the date of non-receipt, the sales contract with our Shop will be considered to have been canceled due to customer convenience. In this case, the customer is exempt from the obligation to deliver the goods and must immediately pay to our Shop a penalty equal to the above damages plus the price equivalent to the relevant goods.

• Product storage period: 7 days

Returns and Exchanges Returns and exchanges are not accepted. However, if the product is recognized as a clear defective item, returns or exchanges will be accepted only if an email stating the specific reasons for the defect is sent to the designated email address of our Shop within 3 days starting from the day following the receipt date, and if such email reaches our Shop. No returns or exchanges will be accepted thereafter for any reason.

Other Rules Regarding the Purchase of Goods In addition to "Orders", "Cancellation of Orders", "Termination Due to Violation of Terms", "Refusal of Receipt, etc.", and "Returns and Exchanges" mentioned above, the payment method for the purchase price of goods sold by our Shop, the timing of the transfer of ownership, the delivery method, the method of canceling the application for purchase, or the method of return shall be in accordance with the displays based on the Act on Specified Commercial Transactions and other methods separately established by our Shop.

Late Payment Charges Customers who delay the payment of monetary obligations to our Shop shall pay late payment charges at an annual rate of 14.6%.

Prohibited Actions Customers are prohibited from engaging in the following actions when using our Shop:

• Actions that violate laws, court verdicts, decisions or orders, or legally binding administrative measures, or actions that promote such violations
• Actions related to criminal behavior
• Actions that infringe the intellectual property rights of our Shop or a third party
• Actions that infringe on the rights of portrait, privacy, reputation, or other rights or interests of our Shop or a third party
• Actions that place an excessive burden on the servers or network of our Shop or interfere with their normal operation
• Actions that hinder the operation of our Shop's services
• Unauthorized access or attempts thereof
• Analyzing the source code of our services through decompiling, reverse engineering, etc.
• Unauthorized and improper access to the systems connected to our Shop or altering or deleting information stored on our Shop's facilities
• Copying, transmitting, transferring, lending, or modifying our Shop's website or software
• Renting, transferring, buying, or selling our Shop's accounts or content for a fee to a third party
• Commercially using information obtained from our Shop
• Engaging in actions for the purpose of obtaining benefits related to our Shop in unintended ways
• Conducting advertising, promotion, solicitation, or business activities on our Shop without permission
• Collecting or accumulating personal information about other customers
• Using our Shop with illegal, fraudulent, or unfair purposes
• Actions that cause disadvantage, damage, or discomfort to other customers or third parties
• Impersonating other customers
• Using other customers' accounts
• Actions aimed at meeting unfamiliar individuals of the opposite sex
• Providing direct or indirect benefits to antisocial forces
• Actions that violate public order and morals
• Using our Shop while walking, driving, or in other situations where using our Shop is inappropriate
• Other actions that our Shop deems inappropriate

Exclusion of Antisocial Forces Customers represent and warrant that they do not currently and will not in the future fall under any of the following items:

• Being a gang member, associated with gang members, someone who has not passed 5 years since leaving a gang, an associate member of a gang, a company related to gangs, a corporate racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns or political activities, or other similar individuals (hereinafter collectively referred to as "gang members, etc.")
• Having a relationship in which gang members, etc., are considered to have control over management if the customer is a corporation or other organization
• Having a relationship in which gang members, etc., are considered to have substantial involvement in management if the customer is a corporation or other organization
• Having a relationship that is recognized as utilizing gang members, etc., for the purpose of seeking unlawful profit for oneself or a third party or for the purpose of inflicting damage on a third party
• Having a relationship that is recognized as being involved with gang members, etc., such as providing funds or conveniences
• Having a relationship that is socially criticized as having a relationship with gang members, etc., if the customer is a corporation or other organization, including its officers or those substantially involved in its management

Customers guarantee not to engage in any of the following actions either by themselves or by using a third party:

• Violent demand behavior
• Unreasonable demands beyond legal responsibility
• Actions that threaten or use violence in transactions
• Acts that damage the credit of our Shop or interfere with the business of our Shop by spreading rumors, using deceit, or using force
• Other actions similar to the preceding items

Usage Restrictions Our Shop may, without prior notice, restrict the use of all or part of our Shop to the customer, or cancel the customer's registration if the customer falls under any of the following items. Our Shop is not responsible for any damages incurred by the customer as a result of actions taken by our Shop based on this article:

• If the customer has violated any provision of these Terms
• If it is discovered that there are false facts in the registration details
• If there is a default in monetary obligations
• If there is no response to communications from our Shop for a considerable period of time
• If there is no use of our Shop for a considerable period of time since the last use date
• If our Shop determines that the customer is a member of an antisocial force or has some kind of exchange or involvement with such forces
• Other cases where our Shop deems the use to be inappropriate

Suspension of Service Provision Our Shop may suspend or interrupt the provision of all or part of the services without prior notice to the customer if our Shop deems any of the following circumstances to exist. Our Shop is not responsible for any disadvantage or damage suffered by the customer or a third party in this case:

• When our Shop needs to perform maintenance, inspection, or updating of the computer system related to our Shop
• When the provision of our Shop becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, or the spread of viruses
• When computers or communication lines are stopped due to an accident
• Other cases where our Shop deems the provision to be difficult

Withdrawal Customers can cancel their registration and withdraw from our Shop according to the procedures established by our Shop.

Disclaimer of Warranty Our Shop does not guarantee that the contents provided on our website are free from system bugs or infringements of third-party rights. Furthermore, there is no guarantee of safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose.

Exemption from Liability Our Shop is not liable for any damages arising from the use of our Shop. However, if the contract between our Shop and the customer regarding our Shop (including these Terms) becomes a consumer contract as defined by the Consumer Contract Act, this exemption clause does not apply. Even in cases where it is a consumer contract, our Shop shall only be liable for damages that are directly and actually incurred by the customer due to the negligence of our Shop (excluding gross negligence), and the compensation amount shall be limited to the purchase price of the goods directly related to the damage.

Change of Service Content Our Shop may change the content of our Shop or stop or end the provision of our Shop without notifying the customer. Our Shop is not liable for any damage caused to the customer by this.

Changes to the Terms Our Shop may change these Terms at any time without notifying the customer. The revised Terms will take effect from the time they are displayed on our Shop's website. Customers who continue to use our Shop after the change of these Terms are deemed to have agreed to the revised Terms.

Handling of Personal Information Personal information obtained through the use of our Shop will be handled appropriately in accordance with our Shop's Privacy Policy.

Notification or Communication Notification or communication between the customer and our Shop shall be conducted by the method established by our Shop. Our Shop will consider the current registered contact information to be valid and will send notifications or communications to that contact information, which will be deemed to have reached the customer at the time of dispatch, unless our Shop receives a change notification from the customer in the manner specified by our Shop.

Assignment of Rights and Obligations Customers may not transfer or provide as collateral their position under the usage contract or rights or obligations based on these Terms to a third party without the prior written consent of our Shop.

Business Transfer If our Shop transfers its business to another company (including cases of business transfer, company split, or other cases where the business is transferred), our Shop may transfer the customer's position under the usage contract, rights and obligations based on these Terms, and the customer's information to the transferee of such business transfer. Customers are deemed to have agreed in advance to such transfer.

Applicable Relationship These Terms apply to all relationships related to the use of our Shop between the customer and our Shop. In addition to these Terms, our Shop may establish rules for use. These rules constitute a part of these Terms regardless of their name. If there is a contradiction between these Terms and the rules, the rules will take precedence.

Severability Even if any provision or part of these Terms is judged to be invalid or unenforceable, such judgment shall not affect other parts, and the rest of these Terms shall remain valid and enforceable.

Governing Law The interpretation of these Terms shall be governed by Japanese law.

Jurisdiction In the event of a dispute arising from the use of our Shop, the following district court shall be the exclusive agreed jurisdictional court of the first instance. Yokohama District Court
